Tips For Retail Franchise Startups

There are many retail franchise opportunities available, and as a potential franchisee, you need to know all the necessary information and tips to be successful.

The first thing you need to know about is the Uniform Franchise Circular Offering (UFOC). By law, the UFOC is a document that a franchisor must present to the potential franchisee.  The document contains extensive information about the target franchise. Additionally, the potential franchisee must be provided with extensive and complete contracts that cover all material points a minimum of five days prior to the actual execution of the documents. This time allows the interested party the opportunity to review the contracts with a lawyer and provides a sufficient cooling off period to ensure the final decision is not only emotional, but rational as well.

Another important detail for potential franchisees to find out previous to the execution of the franchise are complete financial details. By law, a company must decide whether or not they want to estimate the amount of money a franchisee will make. If they decide to make and provide an estimate, they must have proof that most of their existing franchise locations are that similarly successful. Most franchisors will not make such estimated earnings claims to prospective franchisees, but it is important, and you can find out if the company you are interested in has an estimated earnings claim by reviewing Item 19 of their UFOC. Be sure that the franchise is not stating unspecific claims, such as you will "earn a lot of money," without any documented proof.  Such claims without proof is called puffing, and is legal but not necessarily ethical.  It is, however,  both illegal and unethical for a franchisor to give you a set amount, or even state that you will earn six-figures without any proof.
